Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of medicalartstelehealth.com and the services offered through it (together, the "Services"). By creating an account, completing an assessment, or placing an order, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Services. We ship nationwide from a US licensed pharmacy. A licensed provider still has to determine that treatment is appropriate for you.
The telehealth relationship
Medical Arts provides administrative and technology services that connect you with independently owned and operated medical practices and the licensed providers who staff them. Medical Arts itself does not practice medicine, diagnose conditions, or prescribe medication. All clinical decisions, including whether to prescribe, are made solely by the licensed provider who evaluates you, based on their independent clinical judgment.
No guarantee of prescription
Completing an assessment does not guarantee that you will be prescribed any medication or approved for any program. A licensed provider reviews your information and determines whether treatment is appropriate for you. If a provider determines that a program is not right for you, or that an in-person evaluation is needed, they may decline to prescribe. Completing the assessment is free and there is no provider review fee, so if a provider does not prescribe, you are not charged at all. Results vary and are not guaranteed.
Membership, billing, and auto-renewal
Programs are billed as a recurring membership on a monthly or quarterly basis, depending on the plan you select at checkout. By starting a membership, you authorize us to charge your payment method on file each billing cycle until you cancel. Your membership renews automatically at the then-current price unless you cancel before your next billing date. We will provide advance notice of any price change as required by law.
Membership fees generally include your provider visit and review, prescribed medication when appropriate, dose titration, monthly check-ins, and shipping. No insurance is billed. Exact pricing and what is included are shown to you before you pay.
Cancellation
You may cancel your membership at any time by contacting our care team, or from your patient portal once your account is set up. Cancellation stops future billing; it does not refund charges already processed. See our Refunds & Cancellation policy for details on timing and what is refundable.
Acceptable use
You agree not to misrepresent your identity or health information, use the Services for any unlawful purpose, attempt to obtain medication through fraud or misrepresentation, resell or redistribute medication, or interfere with the security or operation of the Services. We may suspend or terminate your access for violating these Terms.
Intellectual property
All content on the site, including text, graphics, logos, and software, is owned by Medical Arts or its licensors and protected by intellectual property laws. You may not copy, modify, or distribute our content without written permission.
Disclaimers
The Services are provided "as is" without warranties of any kind, express or implied. Compounded medications dispensed through our pharmacy partners are not FDA-approved; the FDA does not verify the safety, effectiveness, or quality of compounded medications the way it does for approved drugs. Weight-loss and other treatment results vary by individual and are not guaranteed. Nothing on this site is a substitute for emergency medical care; if you are experiencing a medical emergency, call 911 or go to the nearest emergency room.
Limitation of liability
To the fullest extent permitted by law, Medical Arts and its affiliates will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve months before the claim arose. Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable law, including claims arising from the professional negligence of a treating provider, which are governed by the laws applicable to medical malpractice claims in the relevant jurisdiction.
Arbitration and governing law
Except where prohibited by law, any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in small claims court. You and Medical Arts each waive the right to a jury trial and to participate in a class action. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where superseded by federal law.
Changes to these terms
We may update these Terms from time to time. We will post the revised Terms on this page with a new "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
